TERMS & CONDITIONS

The terms for buying and using eSimply Travel eSIMs.

1. Introduction

These Terms & Conditions govern your purchase and use of travel eSIMs from esimplytravel.com ("eSimply Travel", "we", "us", "our"), operated by esimplytravel ApS, CVR 46238648, Doorn Allé 10, 2791 Dragør, Danmark, email info@esimplytravel.com. By placing an order you accept these Terms and our Privacy Policy.

2. The service

We resell data-only travel eSIM plans for use on land and at sea. Connectivity is delivered by underlying mobile network operators and our eSIM supplier; we are a reseller. eSIMs are digital and supplied as a QR code + setup guide emailed to the address you provide.

3. Your device and responsibilities

You must have an unlocked, eSIM-compatible device with up-to-date software. Checking compatibility before purchase is your responsibility. We cannot refund an eSIM that fails to work because your device is locked, incompatible, or misconfigured. You must use the service lawfully and not resell or redistribute it.

4. Orders, prices and payment

• Prices are shown in EUR. Applicable VAT is determined by your location and calculated at checkout, so the total (including any VAT) is shown before you pay. • Payment is handled by Stripe; we do not store your card details. • A binding contract is formed when we confirm your order and send the eSIM. We may cancel and refund an order that was clearly mispriced or where we reasonably suspect fraud or abuse.

5. Delivery, activation and validity

• Delivery is electronic, normally within minutes, to your email (check spam). • Install the eSIM before you travel (with Wi-Fi); activate on arrival. • A plan's validity starts on activation / first network connection (or as stated on the plan). Unused data and validity expire and are not carried over or refunded.

6. Coverage, speed and the "at sea" service

• Coverage and speed depend on the underlying networks and are not guaranteed. We do not promise any particular speed, latency, or uninterrupted availability. • At-sea/cruise coverage uses maritime networks where available and varies by vessel, route, distance from shore and port conditions; dead zones can occur. Buy at-sea plans on this understanding.

7. Fair use

Where a plan is described as "unlimited", usage that is excessive or that degrades the network for others may be speed-limited or restricted in line with the supplier's fair-use policy. Tethering/hotspot use beyond ordinary personal use may be limited.

8. Right of withdrawal (consumers)

You have a statutory 14-day right of withdrawal under the Danish Consumer Contracts Act (forbrugeraftaleloven). Because an eSIM is digital content supplied immediately: • The right applies to an eSIM that is unactivated, not downloaded and unused. • At checkout you expressly consent to immediate supply and acknowledge that you lose your right of withdrawal once supply/activation begins. We confirm this in your order email (durable medium). • To withdraw an eligible (unused) eSIM within 14 days, email info@esimplytravel.com with your order number. You may use the standard withdrawal form.

9. Refunds and returns

• Unactivated, within 14 days: full refund. • Activated or used: generally non-refundable, as the digital service has been supplied. • If it's our fault: if an activated eSIM does not work due to an error on our side, a defect, or non-availability of the service we sold, we will provide a working replacement or refund the unused portion. Tell us within 30 days. • Refunds apply only to purchases made directly at esimplytravel.com, to the original payment method. Your non-excludable statutory rights are unaffected.

10. Intellectual property

All content, branding and software on the site are owned by us or our licensors and may not be copied or reused without permission.

11. Limitation of liability

• We provide the service with reasonable care and skill. • To the fullest extent permitted by law, we are not liable for interruptions or failures of the underlying mobile/maritime networks, loss caused by your device's incompatibility or misconfiguration, or indirect/consequential loss. • Nothing excludes liability that cannot be excluded by law. • Subject to the above, our total liability for any claim is limited to the amount you paid for the relevant eSIM.

12. Data protection

We process personal data per our Privacy Policy. Supervisory authority: Datatilsynet (datatilsynet.dk).

13. Changes

We may update these Terms or the service; the version in force when you order applies to that order. Material changes are notified on the site.

14. Complaints

Contact us first at info@esimplytravel.com — we try to resolve issues quickly. If we can't agree, eligible consumers may complain to the Danish consumer complaints system: Mæglingsteamet for Forbrugerklager / Forbrugerklagenævnet, Nævnenes Hus, Toldboden 2, 8800 Viborg (naevneneshus.dk; portal kpo.naevneneshus.dk). (a minimum claim value applies — currently DKK 1,220 — so some eSIM purchases may fall below it.]

15. Governing law and jurisdiction

These Terms are governed by Danish law, and disputes are subject to the Danish courts. If you are a consumer resident in the EU/EEA, you retain the mandatory protections of your country of residence.
